We at Bengali Herald, Inc. (“Company”, “we”, “us” or “our”), publisher of the Bengali Herald, respect your concerns about privacy. This Privacy Notice (“Notice”) applies to personal customer information obtained by the Company through our services to which this Notice is linked or referenced to, including direct marketing programs, our websites and mobile apps (collectively, the “Services”)

The Notice describes the types of personal information we obtain about customers, how we use the information and with whom we share it. We also describe the measures we take to protect the security of the information and how you can contact us about our privacy practices. The Services are for a general audience, are not targeted to children, and we do not knowingly collect personal information from children under 13 years of age.

  • Vision Statement: Our vision is to create the most trusted and unique online digital platform to share and exchange the wealth of knowledge. We envision to build a strong media network for collaborative efforts and sharing to enrich Bangladeshi communities around the world to empower them for building a better community.
  • Ethics: This represents a synthesis of Bengali Herald policies and is not meant to be comprehensive. These policies are meant to guide Bengali Herald journalism as we deliver news and information in a rapidly changing media environment. We consider these guidelines to be a “living document” that we will continually modify and update based on feedback from our journalists, from our readers, and from our perceptions of our changing needs. Because the circumstances under which information is obtained and reported vary widely from one case to the next, these guidelines should not be understood as establishing hard and fast rules or as covering every situation that might arise.
  • Verification and fact-checking standards: Bengali Herald reporters have primary responsibility for reporting, writing, and fact-checking their stories. Stories are subject to review by one or more editors. The Post has a multi-level structure for the review and editing of stories that may include fact-checking. These include assignment editors (department heads, their deputy editors and assistant editors) who collaborate with reporters on the origination of stories and typically provide initial review when a story is submitted by a reporter; multiplatform editors (also called copy editors) who often provide initial review on breaking news stories and routinely provide second-level review on print and other less time-sensitive stories; and senior editors who have overall oversight of the daily and weekend report for digital publication throughout the day as well as The Post’s print editions. Editors who oversee digital platforms also may be involved in the presentation of stories as well as headlines, news alerts and newsletters. The number of editors who review a story prior to publication and the extent of their involvement varies depending on a range of factors, including complexity, sensitivity, and the pressure of time.
  • Diversity policy: Diversity is at the core of Bengali Herald journalism. Accurately reporting stories from the United States and around the world means engaging a variety of voices as interviewees and first-person writers, striving for a staff that reflects a range of backgrounds and life experiences, and seeking feedback from all who would give it.

INFORMATION WE OBTAIN

We obtain personal information about customers through the Services, publicly and commercially available sources and from our Company affiliates and/or business partners.  The types of personal information we may obtain include:

  • Contact information (such as name, postal address, email address and telephone and/or mobile numbers);
  • Username and password when you register through our Services;
  • Geolocation data; and
  • Other information you may provide to us, such as through our “Submit a Request” or “Contact Us” feature.

INFORMATION OBTAINED BY AUTOMATED MEANS THROUGH OUR SERVICES

We also may obtain certain information through our Services by automated means, such as cookies (including HTTP, HTML5, and Flash cookies), web beacons, web server logs, JavaScript and similar technologies, including technologies designed to obtain information regarding your use of our Services. The information we obtain in this manner may include IP address, mobile device advertising ID, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken on our Services, and dates and times you access or use the Services. In connection with our mobile apps, we also may obtain your phone number and details about your mobile carrier.

A “cookie” is a file that websites send to a visitor’s computer or other Internet-connected devices to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon” also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server. Through these automated collection methods, we obtain “clickstream data,” which is a log of the links and other content on which a visitor clicks while browsing a website. As the visitor clicks through the website, a record of the action may be collected and stored. We also may use a similar automated means to obtain and store information regarding your actions while using our mobile apps.

We may link certain data elements obtained through automated means, such as your browser or device information, with other information we have obtained about you to let us know, for example, whether you have opened an email we sent to you, what search queries you may have run and what advertisements you may have seen on our Services or on third-party websites and apps. The Company is not responsible for those providers’ information practices.

HOW WE USE THE INFORMATION WE OBTAIN

In addition, we and our third-party service providers may use information collected through automated means including cookies, web beacons, web server logs, JavaScript and similar technologies for purposes such as (1) customizing our users’ visits to and use of our Services, (2) delivering content (including advertising) tailored to our users’ interests and the manner in which our users use our Services, and (3) managing our Services and other aspects of our business.

We may use third-party analytics services on our Services, such as those of Google Analytics. The analytics providers that administer these services use technologies such as cookies, web beacons, web server logs and similar technologies to help us analyze your use of the Services. USER CONTENT LICENSE GRANT

By posting any User Content on the Service, you expressly grant, and you represent and warrant that you have a right to grant, to Bengali Herald a royalty-free, sub-licensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, syndicate, publicly perform, publicly display, and make derivative works of all such User Content and your name, voice, and/or likeness as contained in your User Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Service. You also hereby grant each User of the Service a non-exclusive license to access your User Content through the Service, and to use, reproduce, distribute, display and perform such User Content as permitted through the functionality of the Service and under this Agreement.

END USER LICENSE GRANT

Bengali Herald Service. Subject to the terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service for your personal, non-commercial use only and as permitted by the features of the Service. Bengali Herald reserves all rights not expressly granted herein in the Service and the Bengali Herald Content (as defined below). Bengali Herald may terminate this license at any time for any reason or no reason.

OUR PROPRIETARY RIGHTS

Except for your User Content, the Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and User Content (the “Bengali Herald Content”), and all Intellectual Property Rights related thereto, are the exclusive property of Bengali Herald and its licensors. Except as explicitly provided herein, nothing in this Agreement shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any materials or content accessible on the Service. Use of the Bengali Herald Content or materials on the Service for any purpose not expressly permitted by this Agreement is strictly prohibited. You may choose to or we may invite you to submit comments or ideas about the Service, including without limitation about how to improve the Service or our products (“Ideas”). By submitting any Idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place Bengali Herald under any fiduciary or other obligation, and that we are free to use the Idea without any additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, Bengali Herald does not waive any rights to use similar or related ideas previously known to Bengali Herald, or developed by its employees, or obtained from sources other than you.

INTEREST-BASED ADVERTISING

On our sites, apps and/or emails we and our third-party service providers may obtain information about your activities to provide you with advertising about products and services tailored to your individual interests. We and our third-party service providers also may obtain information for this purpose from third-party websites and apps. This section of our Privacy Notice provides details and explains how to exercise your choices.

We engage third-party advertising networks to help us target our messaging to visitors through interest-based and contextual means. Through these ad networks, we can track your online activities over time and across third-party websites and apps by obtaining information through automated means, as described above. The ad networks use this information to show you advertisements on our Services or other third-party websites and apps that may be tailored to your individual interests. The information ad networks may obtain on our behalf includes data about your visits to websites and use of apps that serve our advertisements, such as the pages or ads you view and the actions you take on those websites or apps. This data collection takes place both on our sites, apps, and emails and on third-party websites and apps that participate in these ad networks. INFORMATION WE SHARE

We may share customer personal information as described above with

  • Our subsidiaries and affiliates, any of whom may use your personal information consistent with this Privacy Notice or for the subsidiary’s or affiliate’s own purposes, including marketing purposes.   • Service providers in the US and other jurisdictions who perform services on our behalf.
  • Our third-party clients or business partners, such as advertisers and social media services and other third parties, for those third parties’ own marketing purposes, such as to serve targeted advertisements.

ACCESSING, REVIEWING, UPDATING AND MODIFYING PERSONAL INFORMATION

You have the right to access, review, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. We may request certain personal information for the purposes of verifying the identity of the individual seeking to access or update his/her personal information records.

NOTICE TO CALIFORNIA RESIDENTS

Subject to certain limitations, California residents may ask us to provide them with (1) a list of certain categories of personal information that we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, and (2) the identity of those third parties. HOW WE PROTECT PERSONAL INFORMATION

The Services may be hosted in and managed from a country outside the country in which you initially provided the information, including the United States. You expressly relieve Bengali Herald from any and all liability arising from your use of any third-party website, service, or content. Additionally, your dealings with or participation in promotions of advertisers found on the Service, including payment and delivery of goods, and any other terms (such as warranties) are solely between you and such advertisers. UPDATES TO OUR PRIVACY NOTICE

This Privacy Notice may be updated periodically and without prior notice to you to reflect changes in our personal information practices. For significant changes, we will notify you by posting a prominent notice on our Services indicating at the top of the Notice when it was most recently updated.

FRAUDULENT BENGALI HERALD EMAILS & PREVENTION

Someone is currently sending out large numbers of spam emails titled “BENGALI HERALD and one easy way to earn extra money”. Fraud is very real and rampant on the internet these days. The fraudster is using an email address of @BENGALIHERALD as the sender address on the email, and BENGALI HERALD is receiving a very large number of bounced emails. The fraudulent emails are requesting emails to BENGALIHERALD@yahoo.com, BENGALIHERALD@hotmail.com to, presumably, find personal details. We have requested that Yahoo & Hotmail take down this account and reported the phishing attempt to them. This notice is to warn any recipient of these emails that they are nothing to do with us and we suggest deleting them immediately. All BENGALI HERALD volunteers have email accounts that look like this: employee name or editor@BENGALIHERALD.com. If the email address does not include @BENGALIHERALD.com, it is NOT from a BENGALI HERALD employee. We are very sorry that some people have such low moral standards as to obstruct our work for orphans and waste our time like this. We apologize for anyone whose time was wasted in our name.
